OFFICIAL TERMS AND CONDITIONS (“Rules”)
Clearco's 2024 Top Ecommerce Awards (the “Program”) is sponsored by CFT Clear Finance Technology Corp. (the “Sponsor” or Clearco). By submitting an application for an Award, each applicant agrees to these Rules and decisions of Sponsor, which are final and binding in all respects.
Award Description: Sponsor is proud to announce the following 2024 Clearco Ecommerce Awards:
- Best Overall ($3,000 USD)
- Best Social Enterprise Ecommerce ($1,000 USD)
- Best Ecommerce Brand ($1,000 USD)
- Best Ecommerce Product ($1,000 USD)
- Best Ecommerce Storefront ($1,000 USD)
- Best Reviews ($1,000 USD)
- Best Social Media Campaign ($1,000 USD)
- Rising Star Award: Top Ecommerce Startup ($1,000 USD)
The recipient for each category will receive the corresponding monetary prize via an ACH transfer.
Program Period: Eligible applicants can submit an application for an Award anytime between 9:00 a.m. Eastern Time (“ET”) on October 1, 2024, and 11:59 p.m. ET on November 8, 2024 (the “Submission Period” extended to November 15 2024).
How to Submit an Application: No purchase, payment, or other consideration is necessary to apply for or be awarded an Award. Applicants are not required to be a current customer of Sponsor. To participate, visit https://clear.co/clearco-2024-top-ecommerce-awards and follow the instructions to complete an Award application during the Submission Period.
Eligibility Criteria: To be eligible for consideration, each applicant must meet the following criteria:
- The applicant must (i) be a business incorporated in a state in the United States of America; (ii) be an active ecommerce business with (x) continued sale of products during the Submission Period, and (y) a minimum 51% of its revenue generated from online selling activities; (iii) make more than $50,000.00 USD in annual gross revenue; (iv) must have been in operation in the United States of America for at least one (1) calendar year prior to October 1, 2024, (v) must provide all data requested in the application.
- The individual applying on behalf of the applicant must (i) be 18 years of age or older at the time of application submission; (ii) be a US citizen, a permanent resident of US, or hold a current and valid authorization issued by the U.S. Citizen and Immigration Services, and (iv) be the owner of the applicant or have signing authority or otherwise proven authorization to act on behalf of the business applicant.
- The application form must be duly completed online at https://clear.co/clearco-2024-top-ecommerce-awards.
- The business must not: be a franchised operation (as the term is generally understood in the business community or as defined by state law); be a not-for-profit or charitable entity; religiously or politically affiliated; or receive government funding on an ongoing basis for its operational expenses.
Each applicant consents to, and agrees to cooperate with, all legal due diligence and background checks that the Sponsor may elect to conduct on the individual applying on behalf of the applicant, any owners, immediate family and/or the business, including in relation to legal proceedings, criminal records, government sanctions, ties with government officials, fines and other claims.
Employees, representatives or agents of Sponsor, their parent, affiliated or related companies, subsidiaries, divisions and all advertising, media buying and promotional agencies, and any businesses that these individuals own or are affiliated with, are ineligible, as well as members of the immediate family of, or persons domiciled with, any of those described above. “Immediate family” means parents, siblings, children or spouse.
All individuals applying on behalf of the applicant and business applicants are subject to review and approval by the Sponsor and/or third parties retained by the Sponsor to assist in the administration of the Awards, in their absolute discretion, to determine their eligibility and selection as an Award recipient. All decisions of the Sponsor and/or third parties retained by the Sponsor to assist in the administration of the Award regarding the Award and these Rules are final, legally binding and are not reviewable by any other body. Limit of one (1) submission per applicant.
Selection Criteria: The following criteria will be considered by the Sponsor and/or third parties retained by the Sponsor to assist in the administration of the Award (the “Judges”) in selecting each of the successful applicants to receive an Award:
- Best Overall: Displays high growth activities, strong revenue performance, offers interesting products, has recent reviews, has strong social engagement and has a well-designed storefront.
- Best Social Enterprise: Has a charitable angle to the brand while being a revenue-driving business.
- Best Ecommerce Brand: Has an interesting and cohesive brand design that spans website, product, packaging, video and social content.
- Best Ecommerce Product: A product that is a key revenue driver and is unique or interesting to the market, garnering purchases, attention, and reviews.
- Best Ecommerce Storefront: An ecommerce store with a well designed storefront that encompasses brand but also creates an accessible and easy-to-purchase experience with features that drive higher cart value.
- Best Reviews: A brand with a high number of reviews that are positive from true customers - featuring fewer sponsored, paid for, or gifted reviews.
- Best Social Media Campaign: Has a social media campaign, whether a single post or multiple, that is engaging, funny, unique, or otherwise entertaining.
- Rising Star Award: A startup ecommerce company that is currently earning revenue but has not been around longer than 5 years and does not earn more than $100,000 USD per year.
The winners will be selected by the Judges based on the subjective opinion of the Judges in consideration of the above noted criteria in each category, as well as any additional information as deemed appropriate and at the sole discretion of the Judges.
Winners will be contacted via the email provided on the application on November 11, 2024 by samantha.lloyd@clearbanc.com and audrianna.frey@clearbanc.com. If no response is received in writing, via email, to the sender addresses, the next winner on the list will be selected. The winner will be contacted no more than 3 times and required to fulfill the Award Criteria including the completion of any declaration or release required by Sponsor within 48 hours. If no response is received and/or the Award Criteria is not fulfilled as determined in the sole discretion of Sponsor, within 48 hours, such winner forfeits its Award and the next winner will be selected and contacted. The corresponding monetary prize for each category will be sent to the winner that fulfills the Award Criteria, as determined in the sole discretion of the Sponsor, within 60 days of fulfillment of the Award Criteria, via ACH transfer.
Winners will be announced on Sponsor’s blog, social media, newsletter, and other channels as determined by Sponsor, in its sole discretion.
Award Criteria: In order to receive an Award, each applicant must agree to the following:
- The individual applying on behalf of the applicant has read, understood and will comply with these Rules.
- The individual applying on behalf of the applicant agrees to complete a declaration and release document provided by the Sponsor that is binding on the business.
- The individual applying on behalf of the applicant declares that she/he/they are the owner of the business named in the submission and that she/he/they have the authority to bind the business and accept the Award on behalf of the business.
- By submitting an application and/or accepting an Award, each applicant authorizes the Sponsor and their representatives, to broadcast, publish and disseminate their owner name(s), business name, logo, trademarks, city and state, information associated with their submission, photographs, video, voice, opinions or any other likeness, and any edits or alterations thereof (collectively, the “Media”), in connection with any promotion or publicity, including, but not limited to, television, radio and social media, with no further compensation, and waive all moral rights therein. The applicant assigns to the Sponsor all rights in its submission, the Media, transcriptions, and translations.
- The applicant agrees to not conduct themselves in any manner that may become the subject of or cause shame, reputational issues, scandal or embarrassment to the Sponsor, including through: any statement, action, or association known to the general public; being charged with any crime involving moral turpitude or a crime related to corruption, bribery, illegal or unethical acts; and any statement or action which the Sponsor may reasonably believe could or would disparage the Sponsor’s or any Sponsor-affiliated product, service, trademark or service mark.
- The applicant agrees that the Award will be used entirely to advance the goals and growth of the business.
If an applicant does not agree to the above, or is subsequently found by the Sponsor to be non-compliant with these conditions or the Rules, the Sponsor may, in their sole discretion, deem that potential recipient ineligible, terminate its relationship with the potential recipient, revoke the offer for the Award, and/or provide the Award to an alternate submission in accordance with these Rules. If the Sponsor makes this determination, then the potential recipient is not entitled to any portion of the Award.
General Conditions:
All submissions are subject to verification. All submissions and application forms are the property of the Sponsor and will not be returned. Proof of submission will not be deemed proof of receipt. Any submission that is incomplete, inaccurate, illegible, mutilated, fraudulent or not submitted in accordance with the Rules or the Sponsor’s instructions is ineligible. Persons who tamper with or abuse any aspect of the program, as solely determined by Sponsor, will be disqualified. The Sponsor will attempt to contact potential recipients three (3) times through the contact information provided in their submissions. If an applicant cannot be reached within five (5) business days, or if they can be reached but decline to proceed or provide the Sponsor with required information to proceed, that applicant will be deemed ineligible.
Awards must be accepted as awarded, may not be refunded or transferred and is not convertible. The Sponsor reserves the right, in their sole discretion, to substitute all or a portion of the Award with an alternate option of equal or greater value for any reason. The Sponsor has the discretion to award all or a portion of the Award to the applicant named in the submission, her/their co-owner, and/or to the named business. Recipients of Awards are responsible for all taxes and fees associated with prize receipt and/or use. Recipients should consult their own tax advisors to determine the taxable nature of the Award.
By participating in the Program, each applicant agree to release and hold harmless the Sponsor, and each of its subsidiaries, affiliates, retailers, and advertising and promotion agencies and all of their respective officers, directors, shareholders, employees and agents, (the “Released Parties”) against any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from participation in this Program or acceptance, use or misuse of the Award or any portion of the Award. Released Parties cannot be held liable for any submissions that are lost, misdirected or late, including as a result of any breakdown, for any reason, of the Program website during the Submission Period, or for any damage to an applicant’s computer or mobile device.
The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Program in whole or in part should human intervention or an event take place that could alter or affect the administration, security, impartiality or operation of the Program as provided for in these Rules. Released Parties shall not be liable should such an event or intervention occur.
This Program is subject to all applicable federal, state and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of participants and the Sponsor in connection with this Program, shall be governed by, and construed in accordance with, the laws applicable in the state of Delaware.
Personal information provided in connection with this program will be used and disclosed by the Sponsor as necessary for the purposes of administering the Program and otherwise in accordance with the Sponsor’s privacy policy at: https://clear.co/legal/privacy-policy
