Clearco Referral Program

Terms and Conditions (updated December, 2021)

These terms and conditions (“Referral Terms”) constitute a legal agreement between you and CFT Clear Finance Technology Corp, a British Columbia (Canada) corporation, and its subsidiaries (“Company” or “Clearco”).

As used in these Referral Terms:

“our”, “us”, “we” and any other similar variation refer to the Company; and
“you” and “your” refer to the individual participant, as the party agreeing to these Referral Terms.

If you participate in this referral program and make a successful referral, you and the person whose business you successfully referred may each be eligible to receive up to $500 (“Referral Bonus”) from the Company, subject to the terms and conditions below (“Referral Program”).

This Referral Program is open only to: (a) legal residents of the fifty (50) United States (including District of Columbia) and Canada (excluding the Province of Quebec), (b) who are the older of 18 years old or the age of majority in the jurisdiction of your residence.
Additionally, in order to be eligible for the Referral Bonus (as defined below):
- the referral must be submitted to us using your unique referral link, which can be generated by registering on the following page: https://clear.co/landing/refer-a-founder; and
- with respect to the referral, such person must: (a) be an active business; (b) not be affiliated to the referrer, or otherwise be a non-arm’s length person (b) have been funded by Clearco within 60 days of the date Clearco receives the referral; (c) have been referred to Clearco in accordance with these Referral Terms; (d) not have been previously referred by another person to Clearco or its affiliates; and, (e) not be a past or current customer of Clearco or known to it, in each case as determined by Clearco in its sole and absolute discretion, (together, a Qualified Referral”).
Participation in this Referral Program is also subject to Clearco's Terms (available at https://clear.co/terms) and Clearco's Privacy Policy (available at https://clear.co/privacy), and by participating in the Referral Program you agree to the same.
With respect to the Referral Bonus, you will receive the Referral Bonus (if eligible) via PayPal on the email address used to generate your unique referral link, and with respect to a Qualified Referral, via PayPal on the primary email address we have on file.
- Any Referral Bonus will be paid approximately 20 business days after Clearco funds a Qualified Referral.
These Referral Terms are not an amendment to, nor do they supersede or waive any term of the revenue share agreement. If there is a conflict between these Referral Terms and the revenue share agreement, the revenue share agreement will govern to the extent necessary to resolve the conflict.
We reserve the right, at our sole discretion, at any time, and without notice, to change, modify, suspend, or revoke all or any part this Referral Program (including the manner of payout, the eligibility requirements and any rights hereunder), including, without limitation, for any person we find or believe to be manipulating or otherwise abusing the process, fairness, or integrity of the Referral Program or that otherwise in our discretion becomes ineligible. We may, to the maximum extent permitted by applicable law and in our sole and absolute discretion, change, modify, suspend or revoke all or any part of this Referral Program or these Referral Terms (including the manner of payout, the eligibility requirements and any rights hereunder) or at any time without reason or notice you, or modify, suspend or cancel the Referral Program if any fraud, technical failures, unauthorized human intervention or other causes or factors beyond our control impair or corrupt any aspect of the Referral Program, including, but not limited to, the administration, security, fairness of the Referral Program or the submission of referrals. We may, in our sole and absolute discretion, disqualify any individual found, without limitation, we find or believe to be: (w) tampering with the referral process or the operation of the Referral Program; (x) acting in violation of these Referral Terms, our Terms of Service or any other agreement you may have with us; (y) manipulating or otherwise abusing the process, fairness, or integrity of the Referral Program or that otherwise in our discretion becomes ineligible; or (z) acting in an unsportsmanlike or disruptive manner or with intent to abuse, frustrate, annoy, demean, threaten or harass any other person. If your referral submission is incomplete or if you use robotic, scripts, macros or other automated or programmed methods, your submission will be automatically void. Referral Bonus obtained through fraudulent activities or activities in violation of the terms and conditions hereunder, or the representations contained herein, will be null and void. Any attempt by any person to deliberately undermine the legitimate operation of the Referral Program may be a violation of criminal and civil law, and, should such an attempt be made, Company reserves the right to seek damages from any such person to the fullest extent permitted by law. Company's failure to enforce any term of these Referral Terms shall not constitute a waiver of that clause.
By sending a referral, you hereby confirm that the referred party is aware of such intended referral, and has granted its consent to being contacted by Clearco to discuss Clearco's products/ services.
All amounts referenced above are, with respect to customer in the US, in US dollars, with respect to customers in Canada, in Canadian dollars, with respect to customers in the United Kingdom, in British Pounds, with respect to customers in Australia, in Australian dollars, and, with respect to customers in the European Union, in Euros.
The promotional offers herein may not be combined or used with any other Clearco offer, discount, promotion, or benefit unless otherwise indicated, and cannot be applied retroactively. Any rights hereunder, if any, are not transferable or redeemable for cash.
All Referral Bonus details not covered by these Referral Terms are at our sole and absolute discretion.
Except where expressly prohibited by law, by accepting the Referral Bonus, the recipient grants to the Company and its designee(s) the right to use and publish their photo (including LinkedIn profile photo), image, name, likeness, voice, opinions, biographical information, video image and audio and other indicia of persona, city and province, territory or state of residence, in connection with this referral program or similar referral program, for promotional, advertising or other purposes, worldwide, in any media now known or hereafter devised, including, but not limited to, the Internet, without payment, notification permission, or other consideration.
